The iBridge.ch platform is operated by DigitalFuture Agency and offers free and paid services for researchers, investors, start-ups, students, foundations, public institutions, companies, and others. The present General Terms and Conditions (hereinafter referred to as "GTC") defines the user conditions as well as the conditions for using the platform. These GTCs can be viewed at any time (even after closure of the contract) by clicking on the "Terms of Condition" link in the footer of each page. Users expressly accept these GTCs at the time of registration and are obliged to comply with them. New services, which are activated in the Community Area after the initial registration, are also subject to these GTC. DigitalFuture Agency reserves the right to change these GTC at any time and without prior notice but will inform the users about any changes. iBridge is offered to users a communication and information platform. This is achieved by displaying and viewing user information, published projects, job offers, research activities or news, as well as offering applications or further information. The networking of the users is carried out with the help of a special algorithm and the users' fields of interest. In addition, the platform allows users to contact each other in the form of "messages". The regulations described in these GTC apply to this.
Information being displayed on the iBridge platform is free of charge and is publicly shared among visitors of the platform. However, the access to further services is rendered only after registration at the moment. For registration, the following guidelines apply:
With the registration the user confirms the correctness, truthfulness, and completeness of his or her data. The user undertakes to make changes to his registration-relevant data him- or herself without delay.
Only the real and true name of an individual or an organization is permitted as a username. The e-mail address used for login must be the user's active e-mail address. The abuse of e-mail addresses created is prohibited.
The user assures that he/she has full legal capacity at the time of registration. Minimum age: The services of the Community Area are not directed to persons under 18 years of age. DigitalFuture Agency reserves the right to block and delete the account of a user without prior notice, if there are indications that the account is used by a person under 18 years of age.
The conditions for the use of the offered information and services on the iBridge platform are automatically accepted with the registration.
Each user may only register once. The user has the possibility to create several profiles with one login.
The iBridge platform cannot technically determine with certainty whether a user registered in the Community Area is the person he claims to be. The iBridge platform therefore does not guarantee the actual identity of the user. Every user must convince himself of the identity of another user.
The free registration gives users limited access to the information published on the iBridge platform. The registration does not incur any costs for the users. The user may purchase access to additional content and functions for a fee. Without the booking of such services, the iBridge-related offers remain free of charge. Separate terms of use apply for all services which can be booked with costs.
DigitalFuture Agency reserves the right to change, interrupt or completely discontinue all or individual services and/or areas of the Community Area at any time and without prior notice. Furthermore, DigitalFuture Agency reserves the right to block access to single or all services at any time without prior notice.
The iBridge platform offers digital services to natural persons and legal entities to present themselves as business or research partners. These services include the placement of advertisements, the presentation through company and private profiles as well as the presentation of company-owned services or activities to present oneself as a valuable business or research partner.
The User undertakes to keep the password created during registration secret. The password is stored encrypted. The iBridge platform itself cannot view the original password. Please note that users will never been asked their passwords outside the login field provided for this purpose.
The iBridge platform allows its users to publish their own data on the platform. By registering, the User accepts the guidelines for submitting information on iBridge platforms. These are:
� Providing true and non-misleading information in the profiles and during communication with other users
� The use of photos and image material for which the user owns the copyright or which he can freely dispose of
� The exclusive provision of data and information that does not infringe the copyright of third parties
The User shall bear the sole responsibility for the contents he/she has posted, with respect to press law, competition law and otherwise. iBridge technically cannot give a 100% guarantee for the timely recognition of contents, which violate these GTC. By using the iBridge platform and further services, the user confirms that he or she has acquired all the necessary rights of use (including copyrights, ancillary copyrights and other rights) for the data and graphical material provided by him or that he can freely dispose of it.
By accepting the General Terms and Conditions, users commit themselves to use the Community Area exclusively for legal purposes. The users acknowledge that it is strictly forbidden to use the account for illegal and/or other purposes that are not permitted under these GTC or to have it used by third parties. Prohibited are in particular (but not exclusively) contents that
are manifestly offensive and promote, incite, or encourage racism, bigotry, hatred or physical violence of any kind against groups or individuals or violence of any kind against property or encourage other undesirable behaviour
are manifestly offensive and promote, incite, or encourage racism, bigotry, hatred or physical violence of any kind against groups or individuals or violence of any kind against property
include naked persons, violence, or offensive depictions
include photographs or videos of other persons published without the consent of such persons;
particularly violate or attempt to violate data protection laws, contract law or the rights of third parties;
publish information that poses or creates a privacy or security risk to any person;
include or support information which is false or misleading to the User's knowledge;
violate intellectual property rights (trademark law, design law, patent law, copyright law), in particular constitute or encourage illegal or unauthorised copies of copyrighted works of other persons, e.g. pirated computer programs or links thereto, information to circumvent factory copy protection devices and pirated music or links to pirated music files;
which includes "spamming" in any form;
promoting, supporting or giving instructions on illegal activities or projects, e.g. content containing the invasion of the privacy of others, the provision or development of computer viruses or the manufacture or purchase of illegal weapons;
contain links to a website that are prohibited under this Article.
A good tone of communication with each other and always relevant comments in discussion forums and compliance with the Code of Conduct for Communities are required.
Users may contact other users in the iBridge network via the iBridge platforms. For this purpose, the iBridge platform offers communication tools (mainly sending messages) on the platform. Users can only get in contact with each other after networking. The built-in Hide-function enables the user to prevent repeated contact by one and the same user. By using the iBridge platform the user gives his consent for the communication function.
DigitalFuture Agency assumes no responsibility for the creation of backup copies. Users are solely and at their own expense responsible for creating backup copies of the contents they have uploaded or stored on the Platform. Any liability on our part due to data loss is explicitly excluded.
By using the services in the Community Area, users do not acquire any intellectual property rights to the content or any rights to the software on which the services are based. The users expressly acknowledge that the software, the pages themselves and all content are protected by copyright and that the users do not receive any licences beyond their own use. The Users expressly acknowledge that they are not entitled to any other intellectual property rights and/or claims to such rights. All rights concerning the platform belong to DigitalFuture Agency.
By uploading contents, the users grant DigitalFuture Agency a worldwide, transferable, sub licensable, free of charge license to use these contents.
Job advertisements iBridge offers its users the possibility to publish job advertisements with the aim to help users to reach high quality candidates for job offers. Job advertisements that are published among the available job offers expire either at the end of the application period or after 90 days. The User is responsible for (i) all postings and content sent to the iBridge platform through the Job Services or otherwise, including but not limited to the job descriptions, creatives, brands, images, URLs and pixels that make up the postings or content for them (collectively, "Postings"); and (ii) all content and features to which the Postings may refer viewers, and redirections ("Targets"). The User is prohibited from reselling or transferring access to the Job Services to other parties. Each posting must refer to a job offer; it is not permitted for a posting to apply for more than one job. The User may not copy, duplicate, imitate, scratch or otherwise reproduce any job posting from the website of a hiring company and upload it as a job posting to the iBridge platform without the prior knowledge and permission of the hiring company. If a recruiting company informs DigitalFuture Agency that the User has done so without its prior knowledge and approval, DigitalFuture Agency reserves the right to remove such entries immediately and without prior notification of the User. By using the Job Service, the User agrees that he/she will not enable or authorise any third party to do so based on the postings, objectives or use of the Job Services:
Create job advertisements without having the reasonable and legitimate intention to recruit for a bona fide job advertisement or the specified specific position
Create job advertisements that intentionally misrepresent the job, the hiring company or the poster;
Create postings for "business opportunities" which require payment or hiring of others or which are similar to franchise, multi-level marketing, club memberships, distribution partnerships or are entirely or almost entirely on a commission basis;
Providing identifiable CVs or application details of candidates to other parties;
Spamming" or otherwise contacting candidates for purposes unrelated to the specific employment opportunity described in the vacancy notice;
Harassing, stalking or contacting candidates after they have asked not to be contacted;
Recruiting staff by deliberate misrepresentation;
Posting job advertisements that do not comply with applicable tax and labour laws of the relevant country;
Create job advertisements, advertise jobs or otherwise employ recruitment or hiring practices that would constitute a violation of the laws of the user's state or country, the state or country where the job is to be performed, or the applicable laws of the jurisdiction governing the LSA between the Parties;
Participate in any tender, communication or transaction that violates any applicable laws or regulations regarding the prohibition of discrimination in employment, or that violates any applicable laws governing legal fitness for employment;
Participate in illegal or fraudulent activities;
Unless expressly authorised in writing by DigitalFuture Agency, use automated means or forms of scraping or data extraction to access, modify, download, query or otherwise collect information from the Platform;
Unless expressly authorised in writing by DigitalFuture Agency, copy, modify or create derivative works of the Job Services or related technologies; or
Create postings that contain malware, spyware or other malicious code or otherwise interfere with the operation of the Job Services or any device or system or violate or circumvent any security measure of the iBridge platform or any third party.
Conditions for data protection and the use of user information can be found under the separate "Privacy Policy".
DigitalFuture Agency shall not be liable for damages caused by gross negligence or intent, as well as for injury of life, body, and health. The liability of DigitalFuture Agency is limited to the damage typical for the contract and not controllable by the client. DigitalFuture Agency assumes no responsibility for platforms linked to the iBridge platform. Linked platforms are not checked or monitored by us for accuracy, adequacy, or completeness. We do not assume liability for platforms which are accessed via links on the platform.
The place of performance is Lucerne. The Cantonal Court of Lucerne is the exclusive place of jurisdiction for all disputes arising from the contractual relationship. Collateral agreements, amendments and supplements must be in writing to be valid. Should one of the provisions of these GTC be invalid, the validity of the remaining provisions shall not be affected.
